My brother was served a summons for Capital One debt. What happens during the waiting period? He was served a summons from Capital One's Attorney. He wrote a letter for validation of the debt and sent it Certified Mail which they had received on 12/23. Does he just wait to see what their response is? If he should do anything, does filing for motion for disclosure or a Sworn Denial come into play anywhere in this situation? When should he file for this? Answer: The time he should have disputed the case, or asked for validation, was BEFORE they started the process to take him to court. Once it gets to this point, it will be up to a judge what happens. He can go to court and plead his case. The judge will listen to both sides, and then determine a judgment (in all likely hood it will be in Capital ones favor. No one forced your brother to take out a credit card or to even use it.) Your brother will have to appear in court. He will have to pay capital one. (if he has any sense he can call capital one and try and make a settlement offer. Answer: If you paid it off the entire balance (we don't know how much the balance was) with no residual finance charges or late fees, you should be on the clear. However, credit cards work just like car loan, you have to call and get the balance including the residual finance charges. That means if you carried the balance from month to month without pay it off completely, the residual will accrue. In your mind at that time, you may thought that you paid it off but because you didn't call to get the complete balance. That remain residual finance charges and late fees can cost you a bundle. Closing the account has nothing to do with the remain balance. You still obligate to pay for the balance of the account whether the account is closed or not. Call the Capital one and they will refer to the collection agency that they sold the account. Make payment arrangement with the collection agency but the fact remains is that the bad mark will stay on your record for 7 years even though you paid it off.

Answer: Capital One is very aggressive about collection defaulted accounts. They have their own in-house collection dept. They will go to court over balances as small as $200. Don't count on that debt just aging off your credit report. It is very likely you will get a summons and Capital One will end up with a judgment against you, including all the accrued interest and fees.
